Atom Tickets Alexa Skill
Terms of ServiceThese Terms of Service (the “Terms”) are between you and Atom Tickets, LLC (“Atom”) and govern your use of the Atom Tickets skill on Amazon’s Alexa service on any Alexa-enabled device (the “Skill”). By enabling, using or accessing the Skill, you agree to these Terms, as updated from time to time. Atom reserves the right, in its sole discretion, to modify these Terms at any time without prior notice to you. If you do not agree to the Terms as modified, you must stop using the Skill. Your continued use of the Skill following any modification of these Terms constitutes acceptance of those changes. These terms apply in addition to, and are not intended to replace, any other agreement or terms and conditions that may apply in connection with any other relationship you may or may not have with Atom (including but not limited to the Atom Tickets Terms of Use), or in connection with Amazon and Alexa.
Please note that Atom transactions made via the Skill are not done through your Atom Tickets account but via guest checkout. As such, any transactions made via the Skill will unfortunately not be associated with or eligible for any benefits in connection with Atom Rewards, registered third-party loyalty programs, or other account-related features.
You understand that the use of the Skill is voluntary. By using the Skill on Amazon's Alexa service on any Alexa-enabled device (e.g., Amazon Echo) you can use voice commands to communicate with us regarding select purchasing features enabled by the Skill. From time to time, Atom may add to or delete the features or functionality available through the Skill without notice to you, and Atom may remove the Skill at any time. Your communication with Atom using the Alexa service constitutes an authorized communication by you. You are solely responsible for all communications with Atom using the Skill and for anyone who uses the Skill. To prevent unauthorized use, you must maintain the confidentiality of the passwords and/or other identification methods that you use to access the Skill. The interactions you have with the Skill take place through Amazon and you hereby authorize Atom to share any necessary information with Amazon in response to your interactions with the Skill.
Please ensure that others do not interact with Atom via the Skill on your behalf, and, if you do not want to be overheard, ensure that you are out of earshot when interacting with Atom via the Skill. It is possible that Alexa (and the equipment Alexa is installed on) and/or Amazon will record your interactions with the Skill or with Alexa. Consult your agreements with Amazon for more details about how interactions are treated by Amazon and your Alexa-enabled device. Your communications with Atom via the Skill are also subject to Atom’s Privacy Policy.
Atom did not develop or manufacture Alexa or your Alexa-enabled device and does not have control over the software that runs on the device, which may include other third-party applications. It's possible that your Alexa-enabled device may not function without error and may not hear you correctly, may incorrectly process words, may incorrectly translate what you said, or may even say something to you different than what we asked it to say. By enabling the Skill and accepting these Terms, you understand and agree that Atom is not responsible for inaccuracies in your communications and interactions with Atom via the Skill.
The Skill is provided to you free of charge. However, you may incur data charges under your mobility or internet service plan associated with an internet connection when you enable, configure and/or use the Skill. The Skill is also provided on an “as is,” “without any warranty,” “without any liability” and “as available” basis. You bear the risk of using the Skill. Atom does not guarantee the quality, accuracy, completeness, or timeliness of the Skill. Atom does not warrant that the functionality or operation of the Skill will be uninterrupted or free from error, or that any defects in the Skill will be corrected. Atom shall have any liability to you for any losses suffered as a result of your use of the Skill. To the fullest extent permitted by law, Atom expressly disclaims all warranties of any kind with respect to the Skill (implied or statutory), including without limitation, those regarding availability, quality, accuracy, fitness for any use or purpose, compatibility with any standards, and noninfringement.
To the extent permitted by law, Atom is not liable for any indirect, special, incidental, exemplary, punitive, or consequential loss or damage arising out of or in connection with the device or your use of the Skill (including without limitation the input of personally identifiable and other information into the Skill). Except as expressly stated herein, the Terms constitute the entire agreement between you and Atom with respect to the Skill. If any of these terms cannot be enforced by any court or other authority, we will delete it from the Terms and it will not affect the remainder of these terms.
